Terms of Service

These Terms of Service ("Terms") govern your use of Consently (the "App"), provided by Dropfeed LLC ("Dropfeed," "we," "us"). By installing or using the App, you agree to these Terms.

1. The service

Consently displays a cookie-consent banner on your Shopify storefront, records anonymized proof of each visitor's choice, and signals consent to Google Consent Mode v2 and Shopify's Customer Privacy API so that tracking runs only after a visitor consents. It also honors Global Privacy Control signals.

2. Eligibility

You must have an active Shopify store and the authority to install apps and modify content on it. You are responsible for activity in your account.

3. Subscriptions, billing, and cancellation

• The App offers a free tier and a paid plan (Pro). Paid subscriptions are billed through Shopify's Billing API and appear on your Shopify invoice. Pro includes a 7-day free trial.
• Plans renew automatically until cancelled. You can cancel anytime by uninstalling the App or changing your plan; cancellation stops future charges.
• Except where required by law or Shopify policy, fees are non-refundable. Plan features are described in the App and on our listing.

4. Acceptable use

You agree not to misuse the App, including: using it for unlawful content, attempting to bypass plan limits or security, reselling the service, or overloading the system. We may suspend access for violations.

5. Compliance responsibility

• Consently provides tools to help you collect and honor visitor consent. Installing the App does not by itself make your store legally compliant with GDPR, CCPA/CPRA, the ePrivacy Directive, or any other law.
• You are responsible for configuring the banner correctly, maintaining your own privacy/cookie policy, and determining what your business must do to comply. We recommend reviewing your setup and consulting your own legal counsel.
• Consently is not a law firm and does not provide legal advice. We do not guarantee any specific compliance, legal, or regulatory outcome.

6. Intellectual property

You retain ownership of your store data and of the settings and content you configure using the App. Dropfeed retains all rights in the App itself, including its software, design, and trademarks.

7. Third-party services

The App relies on Shopify and on our hosting provider (see our Privacy Policy). Consent signaling also depends on Google Consent Mode and Shopify's Customer Privacy API. Your use of those services is subject to their terms. We are not responsible for third-party outages or changes.

8. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Dropfeed will not be liable for indirect, incidental, special, or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid for the App in the 3 months before the claim.

10. Indemnification

You agree to indemnify Dropfeed against claims arising from your use of the App or content you publish in violation of these Terms or applicable law.

11. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access for violations of these Terms or to comply with law.

12. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules.

13. Changes

We may update these Terms; the updated version will be posted here with a new date. Continued use after changes means you accept them.
